This Web Site (the “Web Site”) is owned by Seth Jordan & Breakthrough Publishing, a British Columbia company (“us,” “we,” or “Company”). We created this Privacy Policy (“Privacy Policy”) to explain how we use the information we collect on the Web Site. This Privacy Policy is only applicable to this Web Site, and not to any other Web Sites that you may be able to access from the Web Site, each of which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy.

Information We Collect

We automatically track and collect the following categories of information when you visit our Web Site: 1) IP addresses; 2) domain servers; 3) types of computers accessing the Web Site; and 4) types of web browsers used to access the Web Site (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify you but is helpful for marketing purposes and for improving your experience on the Web Site. We also use “cookies” to customize content specific to your interests.

Our Web Site provides a range of products and services for you to use in connection with marketing campaigns (collectively, the “Marketing Tools”), personal growth (collectively, the “Personal Growth Tools”). In order for us to be able to contact you about your use of the Web Site, Personal Growth Tools and Marketing Tools, we require you to provide us with certain information that personally identifies you (“Personal Information”). Personal Information includes the following categories of information: 1) Contact Data (such as your name, company name, contact information, telephone number, email address, and login name); 2) Financial Data (such as the credit/debit account information for the account you want to establish for billing purposes); and 3) Transaction Data (for example, the name of the person who referred you to us, the names and contact information for people you refer to us, data about specific marketing campaigns and results, consumer contact information such as email addresses and phone numbers, and related marketing materials). If you communicate with us by e-mail, post messages to any of our blogs, chat groups, bulletin boards, or forums, or otherwise complete online forms, any information provided in such communication may be collected as Personal Information.

How your Personal Information Gets Used

We use Personal Information in the following ways: 1) to enable you to use our Web Site, Personal Growth Tools and Marketing Tools; 2) to contact you about our Web Site, Personal Growth Tools, Marketing Tools, and other related products and services in which we think you may be interested; and 3) to customize and tailor your experience on our Web Site.

We do not sell, license, transfer, and/or share the billing information we collect from you, other than for billing purposes. We use an unaffiliated, credit card processing company to process your payments. We transfer your payment information-and you authorize us to do so-to this company solely for this purpose. The company does not retain, share, store, or use your personally identifiable information for any other purposes. We use the Transaction Data we collect to enable users to conduct marketing campaigns, test and analyze results, create campaign-related marketing materials, and to calculate commissions. We also collect and analyze non-personally identifiable Transaction Data and the associated IP address to help us improve our Web Site and Marketing Tools.

Additionally, the registered member that referred you to our Web Site is able to view your email address. Registered members can also display the name and telephone number for the person who referred them to our Web Site, as well as the following information about members of their team (i.e. referrals who become registered users of our Web Site): name, telephone number, login name, and email address.

You may choose not to provide us with any Personal Information. In such an event, you will not be able to access and use our Web Site, Personal Growth Tools, Marketing Tools, or some of the services it provides.

EU 2016/679 - GENERAL DATA PROTECTION REGULATION (GDPR) COMPLIANCE

We strive to fully comply with the new regulations set forth in the GDPR established by the EU. By accessing this Site and our products, you hereby acknowledge that we may process personal data (information relating to an identified or identifiable natural person), including but not limited to: names, addresses, telephone numbers, email addresses, credit card details, financial information, posts on social media websites, and your and others' IP addresses. To the extent any personal data we process is governed by the GDPR, it will be treated in compliance with the GDPR.

Specifically, any personal data we process is collected for a legal and lawful reason, including, but not limited to, providing you with a tailored experience to our website, exposure and access to and our and our affiliates' products, and help you advance your own business. Further, we protect any personal data collected and limit nature and scope of data collected to that which is adequate, relevant and limited to what is necessary in relation to the purposes for which it is being processed ('data minimization'). For example, if you purchase one of our products, we will process the personal data necessary to execute your purchase of the product and allow you to subsequently access and use the product. Such personal data may include your name, mailing address, telephone number, email address, password, payment information (credit card number, bank account information), and/or IP address.

You have the absolute right to withdraw your consent, request erasure, and/or object to our processing of any of your personal data that we may process. Simply send an email to support@nexusprotocols.com with the subject line: "I hereby [withdraw my consent, and/or request reassure, and/or object] to my data being processed under the GDPR" and include in the body of your email your name. Upon receipt of your email we will cease processing your personal data. Should you desire to exercise your right to erasure or object to our processing of your personal data, please also include this request in the body of the email, and we will follow the procedures set forth in GDPR Art. 17, 18, and/or 21. Note, however, that notwithstanding your exercise of your right to withdraw, object and/or request erasure, we will not provide any refunds for products purchased beyond the deadline(s) established for the respective product(s) you purchased.

Upon request, pursuant to GDPR Art. 12 and 15, we agree to provide you with information regarding any of your personal data that we have processed, including the following:

  • the purposes of the processing;
  • the categories of personal data concerned;
  • the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations;
  • where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
  • the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing;
  • the right to lodge a complaint with a supervisory authority;
  • where the personal data are not collected from the data subject, any available information as to their source;
  • the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

 

We take the protection of personal data seriously and not only strive to process and retain it in the safest manner possible but also, we have measures in place that detect and alert us to any data breaches that may occur, and will notify you in the unlikely event that any of your personal data is affected by any breach. Unless you have provided us explicit consent and/or you have volunteered without solicitation such personal data, we do not process any personal data that reveals your racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation.

Confidentiality and Security of Personal Information

We may also (and you authorize us to) disclose your Personal Information to: a) comply with a court order or other legal process or inquiry; b) protect our rights or property; or c) enforce our Terms and Conditions. Your Personal Information is stored on secure servers that are not accessible by third parties. We provide you with the capability to transmit your Personal Information via secured and encrypted channels if you use a similarly equipped web browser.

The Web Site contains links to other Web Sites. We are not responsible for the privacy practices or the content of such Web Sites. We also make blogs, chat rooms, forums, message boards, and news groups available to you. Please understand that any information that is disclosed in these areas becomes public information. We have no control over its use and you should exercise caution when deciding to disclose your Personal Information.

This Web Site is directed at teenagers and adults and not to children under the age of 13. We do not knowingly collect personally identifiable information from children under the age of 13, nor do we knowingly distribute such information. We do not knowingly allow children under the age of 13 to publicly post or otherwise distribute personally identifiable contact information through our Web Site. Similarly, because we do not collect any personally identifiable information from children under the age of 13, we do not condition the participation of a child under 13 in activities on providing personally identifiable information. If we become aware that we have inadvertently received personally identifiable information from someone under the age of 13, we will delete such information from our records. If we change our practices in the future, we will obtain prior, verifiable parental consent before collecting any personally identifiable information from children under the age of 13.

We have implemented a number of security measures to help protect against the loss, misuse, or modification of information we’ve collected from you. Your Personal Information is transmitted to and stored on servers that we have taken steps to protect from unauthorized access or intrusion. We do not ensure or warrant the security of any information you transmit to us. You acknowledge and assume this risk.

We reserve the right, at any time and without notice, to add to, change, update, or modify this Privacy Policy, simply by posting such change, update, or modification on the Web Site and without any other notice to you. Any such change, update, or modification will be effective immediately upon posting on the Web Site. In the event of substantive changes to this Privacy Policy, the new terms will be posted to the Web Site, you will be required to affirmatively assent to its terms, and you may also be notified by email. If any modification is unacceptable to you, your only recourse is not to use the Web Site and Service and to request an immediate termination of your membership. Your express consent or continued use of the Web Site or our Service following posting of a change notice or new Privacy Policy on the Web Site will constitute binding acceptance of the changes.
